The use of services from NextDoorMedia.com.au [hereafter referred to as "NextDoorMedia"], constitutes an agreement to the terms below. You may view our Privacy Policy here.
Account Setup / Email on file
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. If you have a domain name registered with NextDoorMedia, it is your responsibility to ensure that the contact information for your domain account and your actual domain name(s) is correct and up-to-date. NextDoorMedia is not responsible for a lapsed registration due to outdated contact information being associated with the domain. If you need to verify or change this information, you should contact our sales team at sales@NextDoorMedia.com.au. Providing false contact information of any kind may result in the termination of your account.
Domain Names
- We do not warrant or guarantee that the domain name applied for will be registered in your name or is capable of being registered by you. Accordingly, you should take no action in respect of your requested domain name(s) until you have been notified that your requested domain name has been registered.
- Both the registration of the domain name and its ongoing use are subject to the relevant naming authority's terms and conditions of use and you are responsible for ensuring that you are aware of those terms and conditions and can and do comply with them. You irrevocably waive any claims you may have against us in respect of the decision of a naming authority to refuse to register a domain name and, without limitation agree that the administration charge paid by you to us shall be non-refundable in any event.'
- We accept no responsibility in respect of the use of a domain name by you and any dispute between you and any other individual or organisation regarding a domain name must be resolved between the parties concerned and we will take no part in any such dispute. We reserve the right, on our becoming aware of such a dispute, at our sole discretion and without giving any reason, to either suspend or cancel the domain name, and/or to make appropriate representations to the relevant naming authority.
Schedule A ELIGIBILITY AND ALLOCATION RULES FOR ALL OPEN 2LDS

First come, first served
1. Domain name licences are allocated on a 'first come, first served' basis. It is not possible to pre-register or otherwise reserve a domain name.
Registrants must be Australian
2. Domain name licences may only be allocated to a registrant who is Australian, as defined under the eligibility and allocation rules for each 2LD.
Composition of domain names
3. Domain names must:
a) be at least 2 characters long;
b) contain only letters (a-z), numbers (0-9) and hyphens (-), or a combination of these;
c) start and end with a number or a letter, not a hyphen; and
d) not contain hyphens in the third and fourth position (eg. ab--cd.com.au).
Domain name licence renewal period
4. The domain name licence period is fixed at 2 years. It is not possible to license a domain name for a shorter or longer period.
5. Renewal of a domain name licence at the end of the 2 year period is dependent on the registrant continuing to meet the eligibility and allocation rules for the relevant 2LD.
Number of domain names
6. There is no restriction on the number of domain names that may be licensed by a registrant.
auDA's Reserved List
7. auDA's Reserved List contains names that may not be licensed. The list is available on auDA's website at http://www.auda.org.au.
Prohibition on registering domain names for sole purpose of resale
8. A registrant may not register a domain name for the sole purpose of resale or transfer to another entity.
ELIGIBILITY AND ALLOCATION RULES FOR ASN.AU
The asn.au 2LD is for non-commercial organisations.
The following rules are to be read in conjunction with the Eligibility and Allocation Rules for All Open 2LDs, contained in Schedule A of this document.
1. To be eligible for a domain name in the asn.au 2LD, registrants must be:
a) an association incorporated in any Australian State or Territory; or
b) a political party registered with the Australian Electoral Commission; or
c) a trade union or other organisation registered under the Workplace Relations Act 1996; or
d) a sporting or special interest club operating in Australia; or
e) a charity operating in Australia, as defined in the registrant's constitution or other documents of incorporation; or
f) a non-profit organisation operating in Australia, as defined in the registrant's constitution or other documents of incorporation.
2. Domain names in the asn.au 2LD must be:
a) an exact match, abbreviation or acronym of the registrant's name; or
b) otherwise closely and substantially connected to the registrant.
ELIGIBILITY AND ALLOCATION RULES FOR COM.AU
The com.au 2LD is for commercial purposes.
The following rules are to be read in conjunction with the Eligibility and Allocation Rules for All Open 2LDs, contained in Schedule A of this document.
1. To be eligible for a domain name in the com.au 2LD, registrants must be:
a) an Australian registered company; or
b) trading under a registered business name in any Australian State or Territory; or
c) an Australian partnership or sole trader; or
d) a foreign company licensed to trade in Australia; or
e) an owner of an Australian Registered Trade Mark; or
f) an applicant for an Australian Registered Trade Mark; or
g) an association incorporated in any Australian State or Territory; or
h) an Australian commercial statutory body.
2. Domain names in the com.au 2LD must be:
a) an exact match, abbreviation or acronym of the registrant's name or trademark; or
b) otherwise closely and substantially connected to the registrant.
ELIGIBILITY AND ALLOCATION RULES FOR ID.AU
The id.au 2LD is for individuals.
The following rules are to be read in conjunction with the Eligibility and Allocation Rules for All Open 2LDs, contained in Schedule A of this document.
1. To be eligible for a domain name in the id.au 2LD, registrants must be:
a) an Australian citizen; or
b) an Australian resident.
2. Domain names in the id.au 2LD must be:
a) an exact match, abbreviation or acronym of the registrant's personal name; or
b) otherwise closely and substantially connected to the registrant, because the domain name:
(i) includes, or is derived from, one or more words of the registrant's personal name; or
(ii) is a name by which the registrant is commonly known (ie. a nickname).
ELIGIBILITY AND ALLOCATION RULES FOR NET.AU
The net.au 2LD is for commercial purposes.
The following rules are to be read in conjunction with the Eligibility and Allocation Rules for All Open 2LDs, contained in Schedule A of this document.
1. To be eligible for a domain name in the net.au 2LD, registrants must be:
a) an Australian registered company; or
b) trading under a registered business name in any Australian State or Territory; or
c) an Australian partnership or sole trader; or
d) a foreign company licensed to trade in Australia; or
e) an owner of an Australian Registered Trade Mark; or
f) an applicant for an Australian Registered Trade Mark; or
g) an association incorporated in any Australian State or Territory; or
h) an Australian commercial statutory body.
2. Domain names in the net.au 2LD must be:
a) an exact match, abbreviation or acronym of the registrant's name or trademark; or
b) be otherwise closely and substantially connected to the registrant.
ELIGIBILITY AND ALLOCATION RULES FOR ORG.AU
The org.au 2LD is for non-commercial organisations.
The following rules are to be read in conjunction with the Eligibility and Allocation Rules for All Open 2LDs, contained in Schedule A of this document.
1. To be eligible in the org.au 2LD, registrants must be:
a) an association incorporated in any Australian State or Territory; or
b) a political party registered with the Australian Electoral Commission; or

Website Hosting Content
All services provided by NextDoorMedia may only be used for lawful purposes. The laws of the State of Florida, the State of Texas, and the United States of America apply. The customer agrees to indemnify and hold harmless NextDoorMedia from any claims resulting from the use of our services. Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email abuse@NextDoorMedia.com with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation. Using a shared account as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account. Please do not take backups of your backups. Examples of unacceptable material on all Shared and Reseller servers include:- Topsites

- Banner-Ad services (commercial banner ad rotation)
- File Dump/Mirror Scripts (similar to rapidshare)
- Commercial Audio Streaming (more than one or two streams)
- Escrow/Bank Debentures
- High-Yield Interest Programs (HYIP) or Related Sites
- Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
- Sale of any controlled substance without prior proof of appropriate permit(s)
- Prime Banks Programs
- Lottery Sites
- MUDs/RPGs/PBBGs
- Hateful/Racist/Harassment oriented sites
- Hacker focused sites/archives/programs
- Sites promoting illegal activities
- Forums and/or websites that distribute or link to warez/pirated/illegal content
- Bank Debentures/Bank Debenture Trading Programs
- Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.
What is appropriate usage?
NextDoorMedia is designed to serve the web hosting needs of small, independently owned and operated businesses in a single country. It is not appropriate to use our services to support large enterprises or internationally based businesses with a sustained demand that places undue burden on our systems or negatively impacts use by small, independently owned and operated businesses. NextDoorMedia is a shared web hosting service, which means that a number of customers' web sites and other email or storage services are hosted from the same server. NextDoorMedia uses abuse controls to help ensure that use of our services does not adversely affect the performance of our system or other customers' sites.
Resource Usage
User may not:- Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
- Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
- Run any software that interfaces with an IRC (Internet Relay Chat) network.
- Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
- Participate in any file-sharing/peer-to-peer activities
- Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
- Run cron entries with intervals of less than 15 minutes.
- When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")
Intellectual property rights and other consents
You are solely responsible for obtaining any and all necessary intellectual property rights clearances and/or other consents and authorisations, including without limitation, clearances and/or consents in respect of your proposed domain name and merchant services agreements between you and the relevant financial institutions.
Websites Designs and Builds
Payment If cancellation occurs before design is selected and site is put into production, a cancellation fee will apply. Once a site is placed into production, the cancellation fee will be 100% of project quoted. and no refunds will be available.
TECHNICAL SUPPORT BOUNDARIES
NextDoorMedia provides technical support for YOU that encompasses within our area of expertise only. Such expertise includes assistance, troubleshooting, and debugging of our cPanel control panel interface, servers within our immediate responsibility and any other hosting related issues. However, in under no circumstances is NextDoorMedia neither obligated to help YOU in the installations of new application modules, templates and/or programming languages, nor in providing assistance for any errors produced by any applications that have been modified by YOU previously. We will only provide assistance in making sure any EasyApps applications that are installed through the cPanel control panel interface are installed as directed.
Backups and Data Loss
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. NextDoorMedia is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on NextDoorMedia servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by NextDoorMedia.Cancellations and Refunds
NextDoorMedia reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.
Service availability
Uptime If your shared server has a physical downtime that is not within the 99.9% uptime you may receive one month of credit on your account. Approval of the credit is at the discretion of NextDoorMedia dependant upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact sales@NextDoorMedia.com with justification. All requests must be made in writing via email. Uptime guarantees only apply to shared / reseller solutions. Dedicated servers are covered by a network guarantee in which the credit is prorated for the amount of time the server is down which is not related to our uptime guarantee. We shall use reasonable endeavours to provide continuing availability of the Server and the Services.
Changes to the TOS
NextDoorMedia reserves the right to revise its policies at any time without notice.
